Complying with asbestos law

If you are the dutyholder, it is your responsibility to ensure that your site is fully compliant with asbestos law.

The duty to manage asbestos is stipulated in Regulation 4 of the Control of Asbestos Regulations 2012. Failure to comply with these obligations can result in prosecution under the Health and Safety at Work Act, 1974.

The dutyholder is the person or organisation that has clear responsibility for the maintenance or repair of non-domestic premises. If the premises was built or renovated before or during the year 2000, the dutyholder will have legal asbestos responsibilities.
